F.Stewart,showett that Abner
Bankston,late of said County deceased, did on
the September 18,1843 execute to
your petitioner a bond condition to make a title
to your petitioner for half
of lot number 91 in the Twenty-ninety district
of Macon,County
Georgia,containing 101 and 1/4 acres more or less
for fifty dollars each to
Abner Bankston,given for said half of lot of land.....We
pray...To grant him a
lulenisi requiring John Goodman,I.J.R. McCord
to show cause why they should
not be required as adminstrators of said Abner
Buckston deceased to make and
execute to your petitioner a title to and for
said half lot of land in said
bond. Discribed according to the statute in such
cases made and provided of
your petitioner will ever pray.

to be paid whenever titles can
be obtained of the said Bankston having,having
departed this life without
making titles to said lot of land of the said
John F. Stewart....directing
adminstrators of said Bankston to execute his
titles to said
land.....published in the Gazetts of this state.
3 months....Why they should
not make titles...Due and legal service acknowledged
on the within rule and
publication and copy waived Jan.18,1847.

This indenture made this fifteenth day of May
on the year of our Lord one thousand
eight hundred sixteen between John Brown presents
of the community of Georgia
and that of the trustees of said community of
one part and John Stewart.Son of
William of the county of Oglethorpe and
state of aforesaid of the other part
withforth that the said John Brown for and in
consideration of the sum of six
hundred and twenty dollars into this treasury
of the said county,was in hand
paid at and below the sealing and delivery of
this presents the reciept clerk
is hereby acknowledged hath for said and the part
of the said trustees
grant,bargain,and sell and doth by these presents
grant,bargain, and sell unto
said John Stewart his heirs and assign forever
and that lot aforesaid of Land
State lying and being in the five thousand acre
tract of land in this county
of Oglethorpe and state aforesaid on the waters
of Fishing Creek,belonging to
the said trustees containing one hundred acres,line
the more as lot to which
said lot of parcel of land in and distinguished
by a lot number in the five
thousand acre tract aforesaid by the number thirty-
one no.31).To have and to
hold the said lot or parcel of land and all singular
the promise surely
bargained and sold with this and the way of this
rights and members and
apprentices unto this the said John Stewart his
heirs and assign in fee sample
and the said John Brown presents as aforesaid
and this sample and this sample
and office and out of intended use..Capacity shall
said facilitate forever
defend the person aforesaid unto this John Stewart
and his heirs said assign
agent also secondary person or persons which this
said lot or parcel of land
is part therefore now under lease made by the
said trustees of the county.It
is communicated and agreed by and between the
said parties this John Stewart
shall not have possession of this said lot or
parcel of land until the
twenty-fifth of December eighteen hundred and
seventeen until the said lease
will expire subject to which lease the said lot
or parcel ofland or part
thereof is sold and clearly conveyed in county.Whereof
the said John Brown
hath hereunto set office hand and affixed the
seal of the said community the

John McKissack's 1815 will refers to his
daughter as Lucy Stewart. A John Stewart signed receipts for her share
of John McKissack Sr's estate. There are many, many John Stewarts in Georgia
at during this time period. Circumstantial evidence indicates that Lucy
was the wife of John Stewart, however, and that this John was the son of
William and Mary Penn Stewart who moved to Georgia from Virginia.

estate in 1823 a "Stewart Penn" signed for John Stewart's (Lucy Stewart's)
share of John McKissack's estate. We did not have time to research who
or what "Stewart Penn" might be. NOTE: Mary Penn married William Stewart.

Mary Penn Stewart, though there is no further informaton about John mentioned.
